- Maintain academic integrity
School Administrators:
- Configure school-wide settings
- Manage institutional accounts
- Ensure compliance with school policies
- Responsible for user compliance
Parents/Guardians:
- Monitor your child's progress (with school approval)
- Support your child's learning
- Cannot use Kai on behalf of child without authorization
Institutional Customers (Schools):
- These Terms bind your institution
- You're responsible for your users' compliance
- Separate institutional agreements may apply
1.3 Age Requirements
Under 13 Years Old:
- Must have parent/guardian OR school consent
- Parent/guardian must accept these Terms on your behalf
- Special COPPA privacy rules apply
- School may provide consent for school-based use
Ages 13-17:
- Can accept these Terms yourself
- Parent/guardian may also need to accept (depends on school policy)

18 and Older:

2.2 What Kai Is NOT
Important Disclaimers:
Kai is NOT:
- A replacement for classroom teachers or instruction
- A substitute for professional education
- A diagnostic tool for learning disabilities or mental health
- Medical, mental health, or therapeutic advice
- A proctored testing solution
- An official grading system
- A guarantee of educational outcomes
2.3 Limitations You Should Understand
Assessment Accuracy:
- Kai's assessments are for practice and learning, NOT official grades
- Teachers make all final grading decisions
- Assessment results may not be accurate for all students
- Results depend on honest engagement and effort
- Individual learning varies significantly
- Kai should not be used for high-stakes testing without teacher oversight
AI Limitations:
- Kai may provide incorrect information or explanations
- Kai may misunderstand questions or context
- Recommendations may not fit all learning styles
- Kai is trained on existing content and may have biases
- Kai cannot identify learning disabilities or mental health concerns
- Kai works best with honest, engaged use
Educational Outcomes:
- Your success depends on many factors beyond Kai

No Guarantees:
- We don't guarantee grade improvement
- We don't guarantee learning outcomes

3. Your Account
3.1 Creating an Account
Who Can Create Accounts:
- Schools and educational institutions (administrative accounts)
- Parents/guardians (on behalf of minor children)
- Adults (age 13+ with appropriate consent)
- Students (with school or parent permission)
Account Information Requirements:
- Provide accurate, complete information
- Keep information current and updated
- Don't provide fraudulent or misleading information
- You're responsible for information accuracy

3.3 Account Termination
You Can Terminate:

- Settings > Account > Delete Account
- Email support with deletion request
- Deletion is permanent and irreversible
We Can Terminate:
- For violations of these Terms
- For non-payment (institutional accounts)
- For safety/security reasons
- With or without notice (depending on severity)
- Immediately for serious violations
After Termination:
- You lose access to all Kai services
- Your data is handled per our Privacy Policy
- Some data may be retained per legal requirements
- You cannot create a new account without our permission
4. Acceptable Use Policy
You agree to use Kai responsibly and legally. Here's what you cannot do:
4.1 Academic Integrity Violations
Prohibited:
- Using Kai to cheat on tests or assignments
- Submitting Kai-generated work as your own without learning
- Sharing assessment answers with other students

- Bullying, harassing, or threatening others
- Discriminating based on protected characteristics
- Creating sexual content involving minors (zero tolerance)
- Creating adult sexual content (age restrictions apply)
- Promoting illegal activity
- Impersonating others
- Sharing misinformation to cause harm
- Encouraging self-harm or violence
4.3 Security and System Integrity
Prohibited:
- Attempting to hack or gain unauthorized access
- Creating, uploading, or distributing malware
- Disrupting service (DDoS attacks, overload attempts)
- Reverse engineering Kai's technology
- Bypassing security measures
- Attempting credential stuffing or brute force attacks
- Probing for vulnerabilities without authorization
- Accessing other users' accounts
4.4 Privacy Violations
Prohibited:
- Sharing others' personal information without consent
- Doxxing or publicly exposing private information
- Impersonating other users
- Accessing data you're not authorized to see
- Violating others' privacy rights
4.5 Service Misuse
Prohibited:
- Scraping or copying Kai content without permission
- Using automated systems to access Kai (bots, scrapers)
- Reselling access to Kai
- Using Kai for commercial purposes without authorization
- Redistributing Kai content
- Creating derivative products based on Kai
- Overloading systems with excessive requests
- Attempting to reverse engineer our algorithms
4.6 School and Institutional Policies
Your School's Rules Apply:
- Follow your school's acceptable use policy
- Respect your school's academic integrity standards
- Comply with your school's technology policies
- Your school may have stricter rules than these Terms
4.7 Consequences of Violations
Progressive Enforcement:
1. First Violation (typically):
- Warning sent to you and/or school
- Temporary account restrictions
- Required acknowledgment of violation
2. Repeated Violations:
- Account suspension (temporary)
- Loss of access to features
- School/parent notification
- Required remediation steps
3. Serious Violations:
- Account termination (permanent)
- Removal from platform
- School/parent notification
- Possible legal action
4. Emergency Situations:
- Immediate suspension without warning
- For: Threats, illegal activity, severe harm
- Investigation before potential reinstatement
Additional Consequences:
- Reporting to school authorities
- Reporting to parents/guardians
- Reporting to law enforcement (for illegal activity)
- Legal action for damages
- Permanent ban from Kai

5. Intellectual Property

- "Kai the AI" name and logo
- Chi Square Labs branding
- All content we create (tutorials, guides, assessments)
- Our algorithms and recommendation systems
- Our databases and data structures
- User interface design and features
Your Limited License:
- We grant you a limited, non-exclusive, non-transferable license to use Kai
- Only for educational purposes as intended
- Only while you have an active account
- Cannot modify, copy, or redistribute
- Cannot use commercially without permission
5.2 What You Own
Students Own:
- Your original writing and creative work
- Your submitted assignments and essays
- Your original ideas and thoughts
But We May:
- Store copies for service delivery
- Use to provide personalized recommendations
- Show to your teachers (that's the point!)
- Keep per data retention policies
We Will NOT:
- Publish your work without permission
- Share publicly without consent
- Claim ownership of your original work
- Use for purposes beyond providing Kai
Teachers Own:
- Materials and lessons they create in Kai
- Their original teaching content
- Their class notes and plans
But We May:
- Use to improve Kai's service
- Analyze to understand effective teaching
- Keep copies for service delivery
We Will NOT:
- Share publicly without permission
- Redistribute to other teachers without consent
- Claim ownership of teacher-created content

We're Not Liable For:
- Grades or academic performance
- Test scores or assessments
- Learning outcomes or skill development
- Academic progress or improvement

- College admissions or career outcomes
- School achievement metrics
- Student engagement or motivation
Educational Success Depends On:
- Quality teaching (teachers, not Kai)
- Student effort and honest engagement
- School support and resources
- Appropriate use of Kai as a supplement
- Many individual factors
- Factors beyond anyone's control
6.3 Limitation of Damages
MAXIMUM LIABILITY:
Our total liability to you shall not exceed:
- The amount you paid us in the 12 months before your claim
- OR $100 (if you paid nothing)
- Whichever is greater
WE ARE NOT LIABLE FOR:
Under no circumstances are we liable for:
- Indirect damages
- Incidental damages
- Consequential damages
- Special damages
- Punitive damages
- Lost profits or lost revenue
- Lost savings or lost opportunities
- Lost data or corrupted files
- Lost business or business interruption
- Reputational harm or damage
- Educational outcomes or grades
- Student performance or learning
- Damages claimed by third parties
- Any damages not directly caused by our negligence
These limitations apply:
- Regardless of legal theory (contract, tort, negligence, strict liability)
- Even if we were advised damages were possible
- To the maximum extent permitted by law

- Death or personal injury caused by our negligence (where not excludable by law)

6.5 Sole Remedy
If you're dissatisfied with Kai:
- Your sole and exclusive remedy is to stop using Kai
- Request a refund if applicable per our refund policy
- Terminate your account
- That's it - no other remedies available

We're Not Responsible For:
- Third-party services or content
- Links to external websites
- Third-party service interruptions
- Third-party security breaches
- Accuracy of third-party information
- Actions of integrated services
7. Service Availability
We strive to provide reliable service but cannot guarantee 100% uptime. We may perform maintenance, updates, or modifications as needed.
8. Termination
Either party may terminate this agreement. Upon termination, your access to Kai will cease, and your data will be handled according to our Privacy Policy.
9. Payment Terms

10. Dispute Resolution

You agree to indemnify and hold harmless E G Analytics from claims arising from your use of Kai or violation of these Terms.
12. Confidentiality
We maintain confidentiality of your data as outlined in our Privacy Policy. You must keep your account credentials confidential.
13. General Terms
These Terms constitute the entire agreement between you and E G Analytics. If any provision is found invalid, the remaining provisions remain in effect.
